These Terms and Conditions (“Terms”) govern your use of the Spectrum Analytics website at spectrumanalytics.org and the purchase of online training courses and services offered by Spectrum Analytics Consulting Inc., a Florida Profit Corporation (“Spectrum Analytics,” “we,” “us,” or “our”). By accessing our website or purchasing a course, you agree to be bound by these Terms.
1. Services Offered
Spectrum Analytics offers (a) clinical ABA therapy services in Miami-Dade County, Florida, governed by separate service agreements and Florida law; and (b) online professional training courses for Registered Behavior Technician (RBT) certification, continuing education, and caregiver training. These Terms apply primarily to the online training and course purchases. Clinical services are governed by your individual service agreement and our Notice of Privacy Practices.
2. Course Purchases and Payment
All course purchases are processed through our secure payment processor. Prices are listed in US dollars. By completing a purchase, you represent that you are authorized to use the payment method provided. Course access is granted upon successful payment confirmation. We reserve the right to modify pricing at any time; changes will not affect purchases already completed.
3. Refund Policy
Digital course purchases: Refunds are available within 2 days (48 hours) of a payment, provided no course content has been accessed or downloaded. The percentage refunded depends on the plan tier that payment was for: Basic 75% of the price paid, Standard 80%, Premium 85%, and Full Certification 90%. The remaining percentage is retained to cover payment processing and administration. Plan upgrades are treated as a separate payment: an upgrade is refundable within 2 days (48 hours) of the upgrade purchase, at the rate of the tier upgraded to, and refunding an upgrade returns the plan to the previous tier. No refunds are issued after 2 days of a payment, or once any course content has been accessed or downloaded. RBT Mock Exam Pack: a full refund (100% of the price paid) is available within 2 days (48 hours) of purchase, provided no practice exam has been opened or started. Once any exam has been opened, the purchase is non-refundable. Unlike course plans, no processing percentage is retained on Mock Exam Pack refunds. To request a refund, reply to your purchase confirmation email or write to learning@spectrumanalytics.org. RBT Competency Assessment bookings: Non-refundable once scheduled. If you need to reschedule, contact us at least 48 hours before your appointment; one reschedule is permitted at no charge.
4. BACB Disclaimer
Spectrum Analytics is not affiliated with, endorsed by, or approved by the Behavior Analyst Certification Board (BACB). Board Certified Behavior Analyst®, BCBA®, BCaBA®, RBT®, and BACB® are registered trademarks of the Behavior Analyst Certification Board. Our 40-hour RBT training is designed to meet BACB eligibility requirements but does not guarantee certification. Certification decisions are made solely by the BACB.
5. RBT Competency Assessment
The RBT Initial Competency Assessment is a separate service from our training courses. Per BACB requirements, the assessment must be completed within 90 days of your 40-hour training completion date; applicants outside that window are not eligible. Before the assessment you will be asked to sign a Volunteer Service Agreement with Spectrum Analytics. The $149 review and processing fee covers the review of your submitted package and is non-refundable regardless of the review's outcome. A separate $100 assessment fee is due after the Volunteer Service Agreement is signed.
6. Intellectual Property
All course content, materials, videos, assessments, and website content are the intellectual property of Spectrum Analytics Consulting Inc. and are protected by copyright law. Your purchase grants you a limited, non-exclusive, non-transferable license to access course materials for your personal use only. You may not reproduce, distribute, resell, share login credentials, or create derivative works from our content without prior written permission.
7. Limitation of Liability
To the fullest extent permitted by Florida law, Spectrum Analytics shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of our website or courses. Our total liability for any claim arising from a course purchase shall not exceed the amount you paid for that course. Nothing in these Terms limits our liability for gross negligence, willful misconduct, or personal injury.
8. Governing Law
These Terms are governed by the laws of the State of Florida, without regard to conflict of law principles. Any disputes arising from these Terms or your use of our services shall be resolved in the state or federal courts located in Miami-Dade County, Florida, and you consent to personal jurisdiction in those courts.
9. Changes to Terms
We reserve the right to modify these Terms at any time. Updated Terms will be posted on this page with a revised effective date. Your continued use of our website or services after changes are posted constitutes acceptance of the updated Terms. For purchases already completed, the Terms in effect at the time of purchase apply.
